NATO Article 5



Talk on the news tonight (Sunday) is about France invoking Article 5 of the NATO treaty, basically attack one NATO Allie, attack all. This would open the US and the whole world to World War 3.

With the recent horrifying terrorist attack against France gives the Obama administration an opportunity to legalize its previously unconstitutional war against ISIS. Up until now, the war has been illegal because the president lacks congressional authorization for it. Assuming (as is highly likely), that ISIS was indeed behind the attacks, the United States has a legal obligation to help defend France under Article 5 of the 1949 North Atlantic treaty, which created the NATO alliance. Here is the relevant text:
The Parties agree that an armed attack against one or more of them in Europe or North America shall be considered an attack against them all and consequently they agree that, if such an armed attack occurs, each of them, in exercise of the right of individual or collective self-defence recognized by Article 51 of the Charter of the United Nations, will assist the Party or Parties so attacked by taking forthwith, individually and in concert with the other Parties, such action as it deems necessary, including the use of armed force, to restore and maintain the security of the North Atlantic area.
France is a signatory of the North Atlantic treaty, and Friday’s brutal terrorist attack surely qualifies as an “armed attack against [France] in Europe.” Therefore, the US now has a legal obligation to consider the attack against France as an attack against the US itself, and to “assist” France with “such action as it deems necessary,” including “the use of armed force.”

ISIS isn't a recognized nation however so mutual defense pacts don't apply nor does a terrorist attack by 8 individuals count as an armed attack on a nation. That being said I believe the US and all NATO nations should irradiate ISIS every chance they get but I don't think any nation can claim this qualifies as a NATO defense issue.

Thanks for the replies. Wording on a document can always be changed, and ratified The US invoked Article 5 after Sept. 11 2001, and was the first country in NATO to do so since NATO was ratified in 1949. We all know the world is changing right before our eyes. Too many have turned a blind eye. Look how the world changed since 9-11, instead of going through metal detector, you now get x-rayed, sniffed, and even groped in the name of airport security.

As I sit here I still remember the days after 9-11 when I went to downtown Minneapolis and saw Federal Agents standing outside the Federal Reserve Bank here with body armor, and assault rifles. I was driving a company van and they watched me like a hawk. I was never so scared in my life. An image burned into my memory.

These ISIS folks mean business they want us dead, they don't care if its men, women or childern they kill as long as they kill.
